1. Interpretation and Definitions

1.1. Interpretation

Words starting with a capital letter have the meanings defined under the following conditions.

The following definitions have the same meaning regardless of whether they appear in singular or plural.

1.2. Definitions for This Privacy Policy:

  • Account: Refers to the account registered by the user on the Platform.
  • Personal Information (Personal Data): Any information that personally identifies you or helps us identify you (e.g., your name, address, email address, trades, etc.).
  • Data Subject: An identified or identifiable individual (user/you/client).
  • Data Controller: As defined by applicable EU and Serbian laws, a controller means a natural or legal person, public authority, agency, or other body that alone or jointly with others determines the purposes and means of processing personal data.
  • Data Processor: The company that processes personal data on behalf of and according to the instructions of the Data Controller.
  • Our Site: Websites under domains such as AltaXcrypto.io – our Platform used to provide services to you and any other AltaXcrypto.io domains used to inform our users about our promotional, marketing campaigns, and special offers; or any other associated websites that may be created by AltaXcrypto.io in the future.
  • Processing of Personal Data: Any operation or set of operations performed on personal data (e.g., collection, storage, use, disclosure, deletion).
  • Tracking Technologies: Include cookies, web beacons, tracking pixels, and other tracking technologies used on our site, including any form of media, media channels, and mobile websites, to customize the site and improve your user experience.
  • Device: Refers to any device that can access the ALTA X CRYPTO site, such as a computer, mobile phone, or tablet.

2. Who We Are?

AltaXcrypto.io is a digital asset trading platform established in 2023 in Belgrade, Republic of Serbia.

AltaXcrypto.io offers trading on multiple platforms via the website, mobile application, WebSocket, and REST API, providing access to high liquidity order books for the most important currency pairs in the market. Quick buying and selling of cryptocurrencies is available through a simplified interface for all users.

We have developed the platform with an individual approach for each user, from beginners in the crypto world to institutional traders. The coverage of a large number of digital currencies, multiple payment options, and 24/7 support accompany a platform with proven stability that focuses on the security of funds and data.

3. Collection and Use of Your Personal Information

3.1. We may collect your Personal Information if you open an account. This is defined as a collection to provide services by our Business Policy. Please note that if you refuse to share your Personal Information for this purpose, we will not be able to provide you with our services.

3.2. Types of Personal Information we may collect include:

  • Your name
  • Your photographic identification
  • Details from your identification documents (such as driver’s license, passport, ID card), document number, issuance/expiration date, photographic identification, etc.

3.3.1. We will process your Personal Information only to provide services to you, to meet the legal and regulatory obligations arising from the provision of services, and by our legitimate interests.

3.3.2. Based on our obligations and legitimate interests, we may request additional documents to verify your identity and source of funds.

3.3.3. We may use your Personal Information for the following purposes:

  • To provide and maintain our services: including enabling the opening and management of your account and monitoring the use of services.
  • To manage your account: to manage your registration as a user of the services. The information you provide may allow you to access various functionalities of the Services available to registered users, such as enabling transactions on the Platform.
  • To execute a contract: development, compliance, and execution of the contract for the purchase of products, items, or services you have purchased or any other contract with us.
  • To contact you: we may contact you by email, phone, SMS, or other equivalent forms of electronic communication, such as push notifications via our mobile application. These methods may be used to send updates, and informational communications related to the functionalities of our products or contracted services, including security updates when necessary or reasonable for their implementation, and to respond to your inquiries.
  • To provide news, special offers, and general information about other products, services, and events we offer that are similar to those you have already purchased or inquired about unless you have explicitly opted not to receive such information.
  • To manage your requests: to process and manage your requests to us.
  • To ensure the security of your account: for example, if you request to disable two-factor authentication on your account, we may ask you to provide additional Personal Information to verify your identity.
  • To fulfill legal obligations: such as tax reporting, fraud prevention, our reporting obligations, etc.
  • To provide you with information about products and promotions that may interest you, from us and third parties, but only if you have explicitly agreed to receive such information.
  • For market research purposes, such as examining users’ needs and opinions on issues like performance. Unless you have given consent, your data for this purpose will be anonymized.

4. Your Rights Regarding Your Data

4.1. Right to Information: You have the right to be informed about the collection and use of your data. This Privacy Policy aims to provide you with clear and concise information on how we process your data.

4.2. Right to Access: You have the right to access your Personal Information and request details about the processing activities we perform with your data. You can do this by emailing us at dpo@altaxcrypto.io or, where possible, perform these actions yourself on your user profile page. Upon your written request, we will also provide you with a copy of the Personal Information we have retained. A minimal fee may be charged for providing additional copies of your Personal Information to cover administrative costs.

4.3. Right to Rectification: You can request that we correct or update any of your personal information that ALTA X CRYPTO holds, which is incomplete or inaccurate, by emailing us at support@altaxcrypto.io or, where possible, do it yourself on your user profile page.

4.4. Right to Erasure: You have the right to request the deletion of both your account and Personal Information by emailing us at dpo@altaxcrypto.io. ALTA X CRYPTO will process your request unless we have a legal or regulatory obligation or overriding legitimate interest to retain your Personal Information (for example, if you have conducted transactions).

4.5. Right to Object or Restrict Processing: You have the right to object to and restrict the processing of your data in certain circumstances, such as when processing is conducted for direct marketing purposes. To do this, please email us at dpo@altaxcrypto.io or, where possible, take action yourself, for example, by unsubscribing from our marketing emails via the “Unsubscribe” link included in each of our marketing messages.

4.6. Right to Data Portability: You may also request that we transfer your Personal Information to another data controller of your choice.

4.7. Identity Verification: To ensure the confidentiality, integrity, and availability of your information, we may ask you to verify your identity by providing identification documentation and/or other methods before assisting you in exercising your rights. If you refuse to verify your identity, we may refuse to take action regarding your data unless we can ensure that such actions are the actual will of the data subject.

4.8. Automated Decision-Making and Profiling: In providing our services, we may use automated processing and profiling to reduce the risk of fraud, money laundering, and misuse of our services. Through this automated processing, we analyze your identification, transactional, and behavioral patterns. We may not be able to provide you with some or all of our services if you do not wish to undergo such automated processing. 4.9. Response Timeframe: If you submit a request, we have a one-month period to respond. If we are unable to respond within a month, we will inform you and provide an explanation for the delay.

4.10. Non-Discrimination: We will not discriminate against you for exercising any of your rights over your personal information. Unless your personal information is necessary to provide a specific service or offer (e.g., providing customer support), we will not deny you goods or services and/or charge you different prices or rates for goods or services, including offering discounts or other benefits, imposing penalties, or providing you with a different level or quality of goods or services.

4.11. No Fee Required: You will not have to pay a fee to access your data (or to exercise any other rights). However, we may charge a reasonable fee if your request is manifestly unfounded, repetitive, or excessive. Alternatively, we may refuse to comply with your request in such circumstances.

5. Exercising Your Data Protection Rights

5.1. You can exercise your rights to access, rectification, erasure, and objection by contacting us at dpo@altaxcrypto.io. We may ask you to verify your identity before responding to requests.

**5.2. You have the right to file a complaint with data protection supervisory authorities regarding our collection and use of your Personal Data. If you reside in the EEA, Switzerland, or the UK, you have the right to discuss any case in which you believe we may not be complying with the terms of this Privacy Policy or to file a complaint regarding our practices with the supervisory authorities in your country or state.

6. Retention of Personal Information

6.1. Your information is stored on our servers located within the European Union. Access to this information is provided to ALTA X CRYPTO employees whose offices may also be located outside the European Union but who adhere to the same data protection principles and processes as those within the European Union (please see the section on International Data Transfers for more details).

6.2. Information about your payment method used to perform or receive payments from ALTA X CRYPTO is transferred to third-party payment service providers with whom ALTA X CRYPTO has contractual agreements to protect your rights. Unless you open an account with us and make transactions, we do not retain your payment method information.

6.3. We will only retain your Personal Information for as long as necessary for the purposes described in this Privacy Policy and in accordance with our legal and regulatory obligations.

6.4. In accordance with ALTA X CRYPTO’s legal obligations, we will retain Personal Information for a period of five years after the User closes their Account and terminates legal relationships with us, or five years from the end of the tax period in which the User made their last transaction.

6.5. Data retained for regulatory purposes will be protected from unnecessary processing and will only be used for providing information or access to competent authorities.

7. Disposal of Personal Information

7.1. When we no longer must provide you with the service you requested, nor an obligation to retain Personal Information for regulatory or legal reasons, we will anonymize or remove your Personal Information by acceptable industry standards and security standards so that we can no longer access and link it to you.

7.2. Where we cannot directly remove such records, as in the case of archived backups, we will keep a record of which Personal Information needs to be removed if the backup data is ever restored.

8. Tracking Technologies and Cookies

8.1. We use cookies and similar tracking technologies to track activities on our site and store certain information. The tracking technologies used include beacons, tags, and scripts to collect and track information and to improve and analyze our site. The technologies used may include:

  • IP Addresses: We may collect information about your computer, including IP address, operating system, and browser type, for system administration and reporting aggregate information to our advertisers. This is statistical data about the activities and browsing patterns of our users and will not be used to identify an individual unless that individual is identified.
  • Web Beacons: Certain parts of our service and our emails may contain small electronic files known as web beacons (also called clear gifs, pixel tags, and single-pixel gifs) that allow ALTA X CRYPTO, for example, to count users who have visited those pages or opened an email and for other related website statistics (e.g., recording the popularity of a certain section and verifying system and server integrity).

8.2.1. We use browser functionality known as a “cookie,” which assigns a unique identification to your computer. Cookies are typically stored on your computer’s hard drive. Information collected through cookies is used to evaluate the effectiveness of our websites, analyze trends, and administer the Platform. Information collected through cookies allows us to determine, for example, which parts of our websites are the most visited and what difficulties our visitors may have in accessing our websites. With this knowledge, we can improve the quality of your experience on the Platform by identifying and providing more desired features and information, as well as resolving access issues.

8.2.2. We also use cookies and/or technology known as a web bug or clear gif, which is typically stored in emails to confirm your receipt and response to our emails and to provide you with a more personalized experience when using our websites.

8.2.3. We use third-party service providers to better understand the use of our websites. Our service providers will place cookies on your computer’s hard drive and collect the information we select to educate us about how visitors use our websites, which products they view, and basic transaction information. Our service providers analyze this information and provide us with aggregate reports. The information and analysis provided by our service providers will be used to better understand the interests of our visitors on our websites and to better serve those interests. The information collected by our service providers may be linked and combined with information we collect about you during the use of the Platform. Our service providers are contractually restricted from using the information they receive from our websites solely to assist us.

  • Necessary / Essential Cookies: Type: Session Cookies. Administered by ALTA X CRYPTO. Purpose: These cookies are essential to provide you with services available through the website and to enable you to use some of its features. They help authenticate users and prevent fraudulent use of user accounts. Without these cookies, the services you have requested cannot be provided, and we use them only to provide you with those services.
  • Cookies for Acceptance of Policy / Notification: Type: Persistent Cookies. Administered by ALTA X CRYPTO. Purpose: These cookies identify whether users have accepted the use of cookies on the website.
  • Tracking and Performance Cookies: Type: Persistent Cookies. Administered by third parties. Purpose: These cookies are used to track information about traffic on the website and how users use the site. The information collected through these cookies may directly or indirectly identify you as an individual visitor. This is because the information collected is usually linked to a pseudonymous identification that is associated with the device you use to access the site. We may also use these cookies to test new pages, features, or new website functionality to see how our users react to them.

8.3. Analytics: We use Google Analytics, which uses cookies and similar technologies to collect and analyze information about website usage and report on activities and trends. This service may also collect information about the use of other websites, applications, and online resources. Google Analytics is a web analysis service provided by Google that tracks and reports on website traffic. Google uses the collected data to track and monitor the use of our website. 8.4. We do not track all browsers with the “Do Not Track” option that allows you to notify websites that you do not wish to be tracked during your online activity. We currently do not respond to “Do Not Track” browser signals.

9. Disclosure of Personal Information

9.1. We use Personal Information for the purposes indicated at the time you provide such information, for the purposes stated in this Privacy Policy, or as permitted by law.

9.2. Business Transactions: We may make available the Personal Information you provide only for the indicated purpose and during the provision of the service you would request, specifically for:

  • Our partners, agents, and representatives
  • Payment service providers and financial institutions
  • Customer communication platforms
  • Our contractors provide software for identity verification purposes
  • Our contractors provide us with sanction information from publicly available sources

9.2.1. We may also share user Personal Information with financial institutions, insurance companies, or other companies in the event of mergers, splits, or other corporate reorganizations and notify you of such sharing of your information so that you can exercise your rights where applicable.

9.3. Legal Requirements: We may be required to disclose your Personal Information in certain circumstances, such as when required to do so based on valid requests from public authorities (e.g., police or regulatory bodies, courts, etc.). In certain cases, we may not be able to notify you of the data sharing due to legal restrictions.

9.4. Any third party that receives or has access to Personal Information will be required by us to protect such Personal Information and use it solely to perform services that they provide for you or for ALTA X CRYPTO unless required or permitted by law. Such third parties, except for regulatory authorities, will be contractually obligated to adhere to the same or higher levels of security and confidentiality policies as ALTA X CRYPTO and will assume at least the same level of responsibility as ALTA X CRYPTO.

9.5. Legitimate exercise of your rights by ALTA X CRYPTO will also be communicated to third parties to whom access to your Personal Information has been granted.

9.6. We will ensure that each such third party is aware of our obligations under this Privacy Policy and will conclude agreements with such third parties under which they are bound by terms that protect your Personal Information equal to or greater than the obligations we undertake to you under this Privacy Policy, or as imposed on us under applicable data protection laws.

10. International Data Transfers

10.1. Our contractors and affiliates may be located in different countries, including countries outside the European Union (EU), and we may need to transfer your data to third countries to provide our services to you. 12. Processing of Marketing Data, Advertising, and Social Media Pages

12.1. We may use your Personal Information for marketing purposes if you provide your consent during registration or post-registration by checking the marketing preferences boxes on your account profile page. Additionally, we may notify existing Users about our products or services that are similar to those we have already provided based on our legitimate interest.

13. Security of Your Data

13.1. We have implemented technical and organizational security measures to ensure the confidentiality, integrity, availability, and accountability of your Personal Information and to protect your Personal Information from loss, misuse, unauthorized alteration, or destruction. 13.4. We conduct testing, assessment, and evaluation of our technical and organizational measures’ effectiveness regularly. Technical and organizational security measures in place, from time to time, are reviewed in line with legal and technical developments.

13.5. In the event of incidents, personal data leakage, or the failure of the security measures to protect such information, we will notify you without undue delay.

14. Security Measures for Processing Payment Card Data

14.1. ALTA X CRYPTO is fully compliant with PCI DSS (Level 1 Service Provider). PCI DSS (Payment Card Industry Data Security Standard) is an information security standard designed for merchants, financial institutions, and payment service providers to ensure the safety of cardholders’ data.

14.2. Please note that our trusted payment service providers are also PCI DSS compliant.

15. Caution Regarding Fraud, Phishing, and Email Scams

15.1. Please note that ALTA X CRYPTO is not in any partnership with any individuals or organizations who represent themselves as customer support agents and offer customer support services through phone and/or social media channels for a fee. Please be aware that customer support is provided only through the ALTA X CRYPTO website and is always free of charge.

15.2. If you believe that you have been a victim of fraud, phishing, or any scam that impersonates ALTA X CRYPTO, please contact us immediately through the live chat available on our website.

16. Changes to This Privacy Policy

16.1. Our Sites’ policies, content, information, promotions, disclosures, disclaimers, and features may be revised, modified, updated, and/or supplemented at any time and without prior notice at the sole and absolute discretion of ALTA X CRYPTO. If we change this Privacy Policy, we will take steps to notify all users by a notice on ALTA X CRYPTO’s Site and will post the amended Privacy Policy on the ALTA X CRYPTO’s Site.
